This website (www.dv8.co.uk) and all of its contents are the property of DV8 Physical Theatre (DV8) and may be used only for your own personal and/or non-commercial use. You may not modify, copy, distribute, transmit, display, perform, reproduce, publish, license, create derivative works from, transfer or sell any information obtained from this website.
All of the materials contained within this website, including software code, are protected by intellectual property rights and other related rights. You may not reproduce parts of this website in any form without seeking prior permission from DV8 (contact [email protected]).
You are not permitted to link to or use any part of DV8’s website for any reason which is unlawful, defamatory, harmful, obscene or objectionable and, in particular, you are not permitted to transmit anything which harms DV8’s business or reputation or in any way offends other users or persons.
DV8 does not accept any liability arising from your use of the website or any content contained within. We may withdraw or alter the information we provide on our website without notice.
DV8 may record, preserve, trace and disclose anything which has been transmitted to, from or via our website, where required by law or when acting in good faith.
DV8 will collect, use, store and disclose your personal details in accordance with our Privacy Policy.
MEDIA PORTAL
DV8’s Media Portal offers digitized footage of rehearsals and performances.
In order to be able to view the digital content you will need to use a personal computer, portable media player, or other device that meets the system and compatibility requirements. We may change the requirements for compatible devices from time to time and, in some cases, whether a device is (or remains) a compatible device may depend on software or systems provided or maintained by the device manufacturer or other third parties. As a result, devices that are compatible devices at one time may cease to be compatible devices in the future.
All purchases of memberships to view digital content are final. Payments are handled through a secure third party; Stripe.
Access to the Media Portal allows you to view digital content on a subscription basis over a limited period of time during the subscription period.
Digital content available via the Media Portal is prohibited from sharing, downloading, copying, filming or any other form of reproduction or duplication.
Subject to your payment of the membership fee to obtain access to the Media Portal, and your compliance with all other terms we specify in this document, DV8 grants you a non-exclusive, non-transferable, non-sublicensable, limited right and license, during the applicable subscription period, to view the digital content for non-commercial, private use.
When you view digital content, the resolution and quality of the digital content you receive will depend on a number of factors, including the type of compatible device on which you are viewing the digital content and your bandwidth, which may go up and down over the course of your viewing. While we strive to provide you a high quality viewing experience, we make no guarantee as to the resolution or quality of the digital content you will receive when streaming, even if you have paid extra for access to high definition content.
You may not transfer, copy or display the digital content. In addition, you may not: sell, rent, lease, distribute, broadcast, sublicense or otherwise assign any right to the digital content to any third party; remove any proprietary notices or labels on the digital content; attempt to disable, bypass, modify, defeat, or otherwise circumvent any digital rights management system used as part of the Media Portal; or use the Media Portal or digital content for any commercial or illegal purpose.
ADDITIONAL TERMS
a. Termination . If you violate any of the terms or conditions of this Agreement, your rights under this Agreement will automatically terminate without notice from us, and DV8 may, in its discretion, immediately revoke your access to the Media Portal without notice to you and without refund of any fees. In such event DV8 shall have the right, without notice to you, to automatically discontinue your access to the Media Portal.
b. Content. You understand that by using the Media Portal, you may encounter content that may or may not be identified as having explicit language or other features. Nevertheless, you agree to use the Media Portal at your sole risk, and DV8 shall have no liability to you for content that you may find objectionable.
c. Amendments. DV8 reserves the right to make changes to this Agreement at any time. Your continued use of the Media Portal following any such changes will constitute your acceptance of such changes.
